Why Do I need Probate?
- Probate is necessary when the value of the deceased's estate is above £5000.
- Most estates are above the value of £5000 as they usually include property; the majority of estates will enter probate.
- Currently Inheritance Tax is only paid on Estates above the value of £325,000. (as of 2011)

Stages to Probate
There are two stages to probate:
- obtaining the grant of probate
- administering the estate once the grant of probate has been obtained
If you have a small estate and just need a solicitor to apply for and obtain the grant of probate on your behalf, you can save money — though you will have to do a lot of work to gather it in and you will be personally liable (as an executor) for mistakes so you need to be very methodical and diligent to do this.
If you are dealing with a larger estate or where there is a potential for dispute and arguments between the beneficiaries then it may be better to have a solicitor deal with all of the probate on your behalf.
